General Terms and Conditions

Welcome to our website. All users of this website are subject to the following terms and conditions. If you do not agree with these terms and conditions please do not use this website.

1. Agreement/Contract

  1. In these Terms and Conditions “We” or “Us” means Airconditioner Marketplace and “You” or “Your” means the person who accepts these Terms and Conditions, by using this Website, network and processes, including the purchase of products or services through this Website.

  2. By browsing this Website, or placing an Order, You agree to these Terms and Conditions as set out, which constitutes a legally binding contract between Us and You for the supply of Products.

  3. The Contract together with your Order constitutes the entire agreement between Us and You for the supply of Products. The Contract cannot be varied unless Airconditioner Marketplace agrees to modify it in writing or by email.

2. Legal Capacity

You must be a minimum of 18 years of age to be able to place orders with Airconditioner Marketplace. By accepting this Agreement, you acknowledge that you are over the age of 18 years.

3. Use of Site

This website may contain links to other websites. We are not responsible for the content or privacy acts associated with linked websites. We take no responsibility for any damage which may arise in connection with your use of this website.

4. Pricing

All prices shown are inclusive of GST. All prices provided on the Website are subject to change at any time without notice. All prices listed on the Website exclude delivery costs. Delivery costs will be shown separately on an order.

If delivery price comes up $0.00 on the checkout page please email us with your delivery details or ring us and we will promptly give you a delivery price.

5. Product Specifications

Features and specifications of products described or shown on the website are subject to change without notice.
As much as we try to update specifications as soon as models change, there may be times when new specifications do not match new models. If you are unsure, please email or contact us.

6. Orders

Airconditioner Marketplace does not accept any responsibility for orders that are declined, delayed or not accepted due to problems with internet connections.

7. Payment

You can provide your nominated credit card during purchasing on the website. Payments for orders will be processed immediately upon confirmation of your order.

If your payment method triggers fraud protection measures, we may contact you to confirm additional details, or cancel the transaction. Your order will not be completed unless your order has passed our fraud prevention measures.

If additional information is not received within 3 days, your order will be cancelled. Information requests are sent to help protect credit card holders from online fraud.

All goods remain the property of Airconditioner Marketplace until the total price is paid and can be reclaimed without consent.

8. Delivery of Goods

We estimate that delivery time could be between 1 to 10 working days, excluding weekends, public holidays and the days between 24th December until 3rd January.

Please Note – due to current circumstances some delays with certain models may occur and may go over the estimated timeframe of 1 to 10 days. Please confirm with us on stock availability.

Airconditioner Marketplace aims to deliver all products in a prompt and timely manner. Due to factors outside our control, delays may occur in shipping of goods. Airconditioner Marketplace does not accept any liability for loss or damage suffered as a result of such delays.

We do not deliver to PO Box addresses as photo ID and a copy of the online receipt are required upon delivery. We recommend having an additional person at the delivery address to assist with the placement of your items inside your home. Our carriers provide a door-to-door service, which does not include carrying the items inside.

Customers are responsible for ensuring someone is available to accept delivery of their air conditioning system and must present a printed online receipt when the purchase was made. Please thoroughly inspect the goods for any damage before signing the delivery docket. Signing the docket acknowledges that you have received the goods in good order. If signed as “Good Order or Condition” the liability of any damages passes to you. Photo ID must be shown upon accepting goods.

If there is clear evidence of damage to your delivered equipment, do not accept the delivery or sign the docket.

9. Order Collection

A. Estimated Pick-Up Time
The estimated time for order collection is 1 to 10 working days, excluding weekends, public holidays, and the period between 21st December and 3rd January. Delays may occur depending on stock availability and warehouse operations.

B. Pick-Up Locations
Orders may be collected from our primary warehouse in Mount Kuring-Gai, NSW 2083, or from other designated warehouse locations as advised. Pick-up addresses may vary depending on product and location.

C. Stock Availability
It is the customer’s responsibility to confirm stock availability at the preferred collection location prior to placing an order.

D. Warehouse Distribution
Not all products are stored at every warehouse. Inventory levels and product range vary by location.

E. No Inter-Warehouse Transfers
We do not transfer stock between warehouses. Orders must be collected from the warehouse where the item is available.

F. Acceptance of Terms
By placing an order for collection, you acknowledge and agree to these terms.

10. Warranty

All air conditioning units sold by Airconditioner Marketplace are covered by a 5-year Manufacturer’s Warranty.

Warranty will be void if the system is not installed by a fully licensed and qualified tradesperson, or not installed according to the manufacturer’s specifications. Under these circumstances, any service repair costs will be the responsibility of the customer.

For warranty claims, contact the Manufacturer’s customer service department. Proof of purchase, model, and serial number are required.

11. Return Policy

We do not refund, credit, or replace incorrect purchases, or where incorrect information is provided when placing an order. Airconditioner Marketplace will refund or exchange equipment if delivered equipment is found not to be of merchantable quality.

Refunds are only provided where a replacement unit cannot be offered. Faulty units must be returned for assessment. If deemed faulty by the manufacturer, the item may be replaced free of charge.

We cannot accept returns of goods that have been used or attempted to be installed.

12. Copyright

All content on this site, including text, graphics, and code, is copyrighted and is the property of Airconditioner Marketplace. You may copy and print portions of this website only for the purpose of placing an order.

13. Trademarks

All trademarks, service marks, and trade names used in this website are trademarks or registered trademarks of Airconditioner Marketplace.

14. Installation

  • If during installation a steel beam is met where penetration is required, in most cases a condensate pump for drainage will be needed. This is outside general scope of works and will be quoted separately.

  • Upon acceptance of quotation, this becomes a contract meaning the client accepts these Terms and Conditions.

  • All equipment installed remains the property of Airconditioner Marketplace until full payment is received.

  • Airconditioner Marketplace reserves the right to enter premises and recover equipment if payment defaults.

  • We do not take responsibility for consequential damages to property after installation is complete and commissioned.

  • Systems installed during construction must allow adequate roof space for future servicing; additional costs from inaccessibility are the client’s responsibility.

  • Where roof pitch is minimal, the client must advise if ceilings will be lowered; otherwise, additional costs may apply.

  • System maintenance is the responsibility of the owner. Service calls due to misuse, negligence, or poor maintenance will be charged.

  • Warranty does not cover damage from incorrect voltage, flood, fire, lightning, or unauthorised modifications.

  • In some cases, council planning approval may be required for outdoor unit installation. It is the client’s responsibility to obtain necessary approvals.

  • Airconditioner Marketplace is not responsible for existing electrical installations. Any unforeseen electrical issues will be at the client’s expense.
